Obtained a Preliminary Injunction for Our Corporate Client to Keep One of its Corporate Officers Away from the Company Due to His Reckless and Harmful Conduct
Summary of Claims
Our corporate client was in a position that it needed to remove one of the officers due to his reckless and harmful conduct that was putting the company at risk. We held a board meeting and successfully removed the defendant from all of his positions with the company, changed all the locks, removed him from all bank accounts, etc. In retaliation, the Defendant then began disparaging our corporate client, tried to convince its vendors and customers to cease all business with our client, and was harassing employees and refusing to return certain property of the corporation.
Procedural History
We filed a lawsuit in the Orange County Superior Court seeking, among other things, injunctive relief ordering Defendant to stay away from the business, from the employees, vendors/customers, and to return all corporate property.
Result:
The court issued a preliminary injunction against the defendant while the trial was pending after finding a likelihood that our client would succeed on the merits at trial.
