Prevailed on Summary Judgment Against a Mold Claim

Our client was an individual who owned several rental units in Orange County.  A prior tenant filed a lawsuit claiming that the property had mold contamination which led to health issues.  Our client contended that any issues with the property were promptly addressed and that there were mold inspections several times during the tenancy which came back clean.  During discovery, documents were obtained showing that the prior tenant had told other people several years prior to the lawsuit that she  as having health effects which she thought was from mold.  We filed a motion for summary judgment claiming that these communications were proof that the prior tenant did not file her lawsuit within the statute of limitations.  The court agreed and granted summary judgment in our favor and ordered costs of suit to be paid to our client.
